What are the Requirements for an EB-5 Visa?

An EB-5 visa is an opportunity for entrepreneurs—as well as any immediate family they may have—to become eligible for a green card as long as they make an investment in a commercial enterprise in the United States as defined by the USCIS guidelines and plan to create or preserve ten permanent, full-time jobs for qualified United States workers. The program has been around for over two decades and was created in order to stimulate the United States economy by bringing in foreign investors with capital and an intent to create jobs.

In order to qualify for the EB-5 visa, investors have to invest in a new commercial enterprise which is defined as an enterprise that was created after the 29th of November in 1990. It could also include businesses that were created before then, but they must have been restructured or reorganized or the business must have been expanded through the investment by a forty percent increase in net worth or number of employees.

The other requirement is that the investor invests the required amount of capital in the enterprise enough, that it will create full-time positions for at least ten qualifying employees. If the business is not located within a regional center, this means that the positions must be created directly by the commercial enterprise in order to be counted. If the business is located within a regional center, the positions can be directly from the commercial enterprise or indirectly. If the business is in trouble and qualified as such, the investor can rely on job maintenance.

The other thing that must be considered is that the minimum qualifying investment is at least one million dollars unless the business is located in a targeted employment area where the minimum qualifying investment is $500,000 as long as it is a high-unemployment area or a rural area.
